divain. squad
These Terms of Service ("Terms") are the agreement between Divain Team SL ("divain.", "we") and you ("Creator", "you") when you join divain. squad, our creator programme. By creating an account, connecting a social network or using any part of the programme, you accept these Terms, the Privacy Policy and the Content rules for creators. If you do not agree with them, do not create an account.

divain. squad is a voluntary, free creator programme. Its members share divain. products with their audience using their personal Code, may complete content Missions and generate Balance redeemable for divain. products, as well as entries into periodic raffles. Participation does not create an employment, agency, partnership or franchise relationship, and creates no exclusivity obligation for either party. No salary or fixed payment is owed for taking part.
All Content you publish about divain. within the Programme is commercial communication for the purposes of advertising law, even though your reward is Balance and not money, and you must label it as advertising as set out in clause 9.
You must give accurate information and keep it up to date. You are responsible for keeping your password confidential and for activity carried out with your account. Tell us immediately at thesquad@divainparfums.com if you suspect unauthorised access. You can leave at any time (clause 14).
To verify your profile you connect a social network (TikTok, Instagram or YouTube). By doing so you confirm the account is yours and authorise divain. to read, read-only, the metrics needed for the admission check:

divain. never publishes, edits or deletes content on your behalf and never requests publishing permissions. On TikTok we do not store your access token: it is used once to read the metrics above and then discarded, and you can revoke access at any time from the platform's settings. On Instagram and YouTube there is no access to revoke, because we do not ask for any; to undo the connection use Disconnect in your portal profile. The detail of the data processing is in our Privacy Policy.
Admission is decided automatically by comparing the metrics in clause 5 against the published thresholds, except for figures you declare yourself with a screenshot, which a person always reviews. If your application is rejected, we tell you which requirement was not met and you can send the appeal form available on the portal and in the rejection email. A person on the team reviews appeals manually. Admission is at divain.'s reasonable discretion, and divain. may also admit creators who do not reach a threshold but bring clear value to the programme.
Missions are voluntary. Some are limited in time or in number of participants ("flash" missions); places are assigned first come, first served and the portal shows in real time how many are left.
A Mission is rewarded once divain. has reviewed and approved the content submitted. The review checks, against a checklist, that the content meets the brief, these Terms and the Content rules: advertising label, absence of references to other brands, product claims, minors and third-party rights. Content that does not comply may be left pending correction or rejected, always with an explanation.
Approval of a Mission is not legal validation of the content against third parties: you remain its author and responsible for it.
When you submit content to a Mission, or publish content tagging divain. in the context of the Programme, you grant divain. a worldwide, non-exclusive, royalty-free and sublicensable licence to reproduce, adapt (format and duration only), display and distribute that content on divain.'s own channels, its website, its shops, its newsletters and its paid advertising, for 24 months from submission, with reasonable attribution to your username where the format allows. You can ask us by email to stop using a specific piece and we will comply within a reasonable time for future uses.
Where paid advertising runs on your own post, we will ask you in the Mission for the platform's ad authorisation code. We will only ask for it for content that has passed review.
You warrant that the content is yours, that you hold the rights to any music, images or third-party material included, and that any identifiable person appearing has given their consent.
You keep ownership of your content. Nothing here assigns your copyright to divain.
All Content you publish about divain., its products or your Code within the Programme is advertising and you must label it as such always, clearly and visibly before the public consumes the content and without them having to expand the text or look for it:

rémunéré"; in Italian, "Pubblicità". In video, also out loud or with a caption in the first seconds; in live
streams, repeated periodically; in stories, in every one of the sequence.The Content rules set out how to do it and which formulas are not enough. You must also comply with the advertising rules of your country and of each platform, must not make false or misleading claims about the products and must not attribute to them effects beyond what divain. communicates. If, because of your income, your audience and your activity, you are a user of special relevance under Spanish Royal Decree 444/2024, you also meet your own obligations (registration with the CNMC register, protection of minors and rules on commercial communications) and we may ask you to evidence it. divain. may ask you to correct or take down non-compliant content.
Raffles are an additional benefit for active members. Each raffle states on the portal how entries are earned, the prize, the period and the draw date. The draw is made among the entries registered at closing, prizes are not exchangeable for money and winners are notified by email or push notification. If a winner does not respond within the stated period, divain. may designate a substitute.
You undertake not to: impersonate anyone; connect an account that is not yours or use bought, inflated or bot-generated followers or engagement; use bots, scripts or automated means against the Programme; attempt to access other creators' data; probe, scan or interfere with the portal's security; resell or publicly distribute your Code on coupon sites, aggregators or marketplaces; use the Programme for unlawful purposes or to publish hateful, discriminatory, violent or sexually explicit content associated with the brand.
You also undertake to comply with the Content rules and, in particular, not to: name, show, hint at or directly compare with third-party brands in your Content about divain., in any format, language or list, including by pairing divain. references with other brands; demonstrate the tools on divain.'s website by entering, saying or showing other brands; publish Content about divain. without labelling it as advertising; or attribute to the products effects they do not have. The consequences of these breaches are in section 8 of the Content rules and in clause 14.
"divain.", "divain. squad", the logos, the portal, its design and its contents belong to divain. or to its licensors. While you are an active member we grant you a limited, revocable and non-transferable licence to use divain.'s name and official materials solely to promote the products in the context of the Programme. You may not register domains, accounts, trade marks or advertising campaigns using our brand, nor present yourself as an official spokesperson, employee or distributor of divain.
The Programme integrates with TikTok, Meta (Facebook/Instagram), Google (YouTube) and Shopify. divain. squad is an independent programme and is not affiliated with, sponsored, endorsed or administered by any of those companies. Your use of each platform is governed by that platform's terms, and we are not responsible for their availability, for changes to their APIs or for the decisions they make about your account.
You: you can leave at any time by writing to thesquad@divainparfums.com or by deleting your account from the portal itself. Balance not redeemed at that moment is lost.
Us: we may suspend or close an account that breaches these Terms or the Content rules, abuses the Programme or has been inactive for more than 12 months, and we may modify or discontinue the Programme. The specific consequences of breaches of the Content rules — warning and correction, non-approval of the Mission, non-vesting of the linked Balance, temporary suspension of the account and the Code, removal — are described in their section 8. Except in cases of obvious fraud, where we may suspend the account and the Code as a precaution while we look into it, before suspending or closing an account we will tell you the facts and you will have 48 hours to explain yourself. If we discontinue the Programme, or close your account for a reason other than fraud or serious breach, we will give you at least 15 days notice so that you can redeem your Balance.
Changes to these Terms: we may update them; the version in force is always published at this address with its date of entry into force. Material changes are notified by email or on the portal at least 15 days in advance. Continuing to use the Programme after that date means accepting the new version.
Changes to the Content rules: each new version is published on the portal with its date of entry into force and we will ask you to accept it again before you carry on using the Programme.
The Programme is offered "as is" and we do not guarantee uninterrupted availability or any particular level of income, sales, reach or results from your participation. To the extent permitted by law, divain. is not liable for indirect or consequential damage, loss of profit, loss of audience or damage caused by third-party platforms. divain.'s total liability arising from the Programme is limited to the value of the Balance in your account at the time the liability arises. Nothing in these Terms limits liabilities that cannot lawfully be limited, including those arising from wilful misconduct or gross negligence, nor your rights as a consumer. You will hold us harmless against third-party claims arising from content you submit or publish in breach of clauses 8, 9 or 11 or of the Content rules.
The processing of your personal data is described in our Privacy Policy, which forms part of these Terms.
These Terms are governed by Spanish law. Disputes will be submitted, to the extent the law allows, to the courts of León (Spain), except where mandatory rules allow or require you to go to the courts of your place of residence, in particular if you are a consumer. Before going to court, write to us at thesquad@divainparfums.com: we try to resolve any complaint within 30 days.
If any clause is found invalid, the rest remains in force.
These Terms, together with the Privacy Policy, the Content rules and the rules published on the portal for each Mission or raffle, constitute the entire agreement between the parties. On what they govern — advertising labelling, use of the divain. brand and references to other brands — the Content rules take precedence over any more general provision of these Terms.
You may not assign your membership. divain. may assign these Terms in the context of a corporate reorganisation.
These Terms and the Content rules are drafted in Spanish. In the event of any discrepancy between translations, the Spanish version prevails.
