divain. squad
This version replaces 2026-08-v1. Before you carry on using the portal we will ask you to accept it again. Your acceptance is recorded with the date, time, version and the language you read it in.
These rules apply to everyone registered in divain. squad and to all content they publish mentioning divain., its products, their personal discount code or any material we have sent them, on any social network and in any format: video, photo, live stream, story, text, audio, comment or reply to a comment.
Inside the programme, everything you publish about divain. is advertising. You receive something in return — the balance from your first order, the commission from your code, mission balance, product, raffle tickets — and that is, in legal terms, consideration, even though it is not money.
Accepting them is a requirement for using the portal. By accepting them you confirm that you are 18 or older. Your acceptance is recorded with the date, time, version and language it was read in, and we will ask you to accept each new version before you carry on using the portal.
These rules form part of the programme's Terms of Service. On what they govern — how to label advertising, how to use the divain. brand and how to refer to other brands — they take precedence over any more general wording in the Terms. Where versions exist in other languages, the Spanish version is the one that applies.
No other perfume brand may appear in your post: not named, not shown, not hinted at with initials, emojis or bleeps, and in no language. Nor by pairing divain. references with other brands through lists, codes, numbers or tables.
Do not make direct comparisons with a specific brand: not by naming it, not by showing its bottle, not with its logo, and not with the name in the title, the hashtags, the audio, the on-screen captions, the thumbnail, the description or the file name.
If your audience can tell which perfume you mean, it counts as if you had named it. Nods and clues do not work.
Not by typing it, not by saying it, not by showing it on screen, not even pixelated. How to show the Comparator is explained in point 5.
You can talk about price comparing with the perfumes of the same olfactory universe — described by its notes or its family — always in the plural and with the price range shown by divain.'s Price Comparator on the day you publish. Without naming, showing or implying any brand.
Reply: "I don't talk about other brands. Tell me what profile you like — citrus, amber, spicy — and I will tell you which one I would try." Do not delete the question and do not confirm it: answer it like that.
This is mandatory always, in every post about divain. inside the programme, and it does not depend on whether you were paid in money: the balance, the commission, the product and the tickets are consideration. The law requires that whoever sees you knows it clearly before consuming the content, without having to look for it or expand the text.
How to comply, and do it both ways:

rémunéré"; in Italian, "Pubblicità". Not hidden among twenty hashtags nor at the end of the paragraph.In videos, say it out loud too or caption it in the first seconds and keep the caption. In live streams, repeat it regularly, because people join halfway. In stories, in every one of the sequence, not only the first.
Not acceptable: "collab", "sp", "ad" lost among the hashtags, "#ad" in a Spanish-language text, putting it only in your bio or in another post, or simply thanking divain.
If, because of your income, your audience and your volume of videos, you are a "user of special relevance", you also have your own obligations (registration with the CNMC register, protection of minors, rules on commercial communications). Meeting them is your responsibility and we may ask you to evidence it.
divain.'s Price Comparator does one thing: you choose what you like and it sorts perfumes from that olfactory universe from cheapest to most expensive, with a link to each shop. It does not say what anything resembles, because smell cannot be measured. If you show it:
The same applies to any other search or recommendation tool on divain.'s website: never enter, say or show another brand.
If before joining the squad you published content that names, compares or equates a divain. with another brand, you have seven days from your registration to delete or edit it on the channels you control. If there is content of that kind you cannot edit — because it is on third-party channels — tell us from the portal. This is a condition for staying in the programme.
Putting another brand into your content, comparing a divain. with a specific brand or hinting at it may be trade mark infringement and an act of unfair competition (unlawful comparison, taking unfair advantage of another's reputation). The consequences would fall on you, as the author of the post, and on divain., as the advertiser. Outside Spain too: if your audience is in Germany, German law treats it the same way.
That is why we ask you to describe each divain. by its own notes, its longevity and its price, without referring to any brand or giving away which one it is. The olfactory universe is there to describe the divain. and to place its price in a range; it is not a disguised way of naming another perfume.
The duty to label advertising protects whoever sees you and it protects you too: liability for not flagging it lies with the creator.

Before suspending anyone we tell you the facts and you have 48 hours to explain yourself; only in cases of obvious fraud do we suspend the account and the code as a precaution while we look into it. To decide the consequence we look at the reach of the post, how long it was online, whether it was careless or deliberate, whether it is repeated and how quickly you fix it.
There are no financial penalties in the programme: the consequences are those in this table and, if your post causes harm to divain. or to a third party, whatever liability corresponds for that harm. Campaign contracts with professional creators or agencies may set out their own conditions.
Before approving a mission we review your piece against a checklist: advertising label, brands, hints, tools, prices, product claims, minors and third-party rights. If something does not pass, we tell you what it is and how to fix it. Our approving a mission does not make your content legally vetted against third parties: you remain its author.
When you submit a mission, or publish tagging divain. in the context of the programme, you authorise us to use that content on divain.'s channels — social, website, shop, newsletters and paid advertising — for 24 months, adapting only its format and duration and crediting your username where the format allows, under the conditions in the Terms. Where paid advertising runs on your own post, we also need your ad authorisation code, which we will ask for in the mission and only for content that has passed review. You can withdraw your authorisation for future uses by writing to thesquad@divainparfums.com. You remain the owner of your content.
You warrant that the content is yours, that you hold the rights to any music, images or third-party material you include, and that identifiable people appearing in it have given their consent.
If you are not sure whether something can be said, ask before publishing: thesquad@divainparfums.com. Asking carries no penalty; publishing and having to take it down does.
Rule of thumb: you can talk about divain., its notes and its prices; you cannot talk about other brands.
These rules complement the Terms of Service and the Privacy Policy. On what they govern, these rules prevail; on everything else, the Terms. If there are differences between versions in different languages, the Spanish version is the one that applies.
